1. Acceptance of Terms

By accessing or using Viewbot.dev (the "Service" or "Viewbot"), operated by Officely, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Viewbot is an omni-channel communication platform that enables businesses to manage customer communications across multiple messaging channels. We act solely as an independent technology provider and platform facilitator.

3. Independence and No Affiliation

All product names, logos, trademarks, and brands referenced within the Service or these Terms are the property of their respective owners and are used solely for identification and descriptive purposes. Their use does not imply any affiliation with, sponsorship by, or endorsement by those owners.

Any integration Viewbot offers with a third-party provider (including messaging platforms and AI providers) is provided purely as an optional technical convenience. Your use of any third-party service is governed by, and subject to, that provider's own terms of service and privacy policy, over which we have no control and for which we accept no responsibility.

4. Channel Support and Third-Party Providers

Important Notice: Viewbot supports multiple messaging channels, including official and unofficial third-party providers such as Green API and the Meta WhatsApp Business API. We explicitly disclaim all responsibility and liability for:

• The operation, availability, reliability, pricing, or continuity of any third-party messaging channel or provider
• Any changes, deprecations, or discontinuation of third-party APIs or services
• Any violations of third-party terms of service resulting from your use of official or unofficial channels
• Account suspensions, bans, rate limits, or terminations imposed by messaging platforms or providers
• Loss of data or messages transmitted through third-party channels
• Any damages or losses arising from the use of any official, unofficial, or third-party messaging provider

You acknowledge and agree that you use all messaging channels at your own risk and are solely responsible for compliance with each platform's terms of service.

5. User Responsibilities

You are solely responsible for:

• All content sent through the Service
• Compliance with all applicable laws and regulations, including anti-spam laws
• Obtaining necessary consents from message recipients
• The security of your account credentials
• Your third-party API keys (such as OpenAI or Anthropic/Claude keys) and their usage costs
• Ensuring your use complies with terms of service of connected messaging platforms and AI providers

6. AI Provider Integration

The Service can integrate with third-party AI providers (such as OpenAI, Anthropic/Claude, and others) for AI-powered features. Where required, you must provide your own AI provider API key. You acknowledge that:

• Any AI provider API key you supply is your property, not ours
• You are solely responsible for all costs incurred through your AI provider usage
• We do not store, control, or have access to funds in your AI provider accounts
• You are responsible for monitoring and managing your AI provider usage and costs
• We bear no responsibility for AI provider charges, overages, model availability, output accuracy, or billing disputes
• Viewbot is not affiliated with, endorsed by, or sponsored by OpenAI, Anthropic, Google, or any other AI provider

7. Data Storage and Privacy

We store certain data in our database to provide the Service, including:

• User account information
• Message history and conversation data
• Contact information
• Usage analytics and metadata

8. Payment Terms

All fees for the Service are billed and invoiced by Officely, LLC, the operator of Viewbot.dev. The following terms apply to all payments:

8.1 No Refunds

All payments are final and non-refundable. We do not provide refunds, credits, or pro-rated reimbursements for:

• Partial subscription periods
• Unused service time
• Account suspensions or terminations due to Terms violations
• Third-party platform suspensions or bans
• Service dissatisfaction
• Changes in pricing

8.2 Price Changes

We reserve the right to change our pricing at any time without prior notice for new customers. For existing customers:

• Price changes will be communicated 30 days in advance
• You may cancel your subscription before the new price takes effect
• Continued use after the notice period constitutes acceptance of new pricing
• If you cancel, no refund will be provided for the remaining subscription period

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL LIABILITY AND WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES, LOSSES, OR COMPENSATION OF ANY KIND ARISING FROM OR RELATED TO THE SERVICE
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS — EVEN IF ADVISED OF THE POSSIBILITY
• WE ARE NOT LIABLE FOR SERVICE INTERRUPTIONS, DOWNTIME, DATA LOSS, AI OUTPUTS, OR THE ACTS, OMISSIONS, OUTAGES, BANS, OR SUSPENSIONS OF ANY THIRD-PARTY PROVIDER (INCLUDING META/WHATSAPP, GREEN API, AND AI PROVIDERS)
• WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM USE OF OFFICIAL OR UNOFFICIAL MESSAGING CHANNELS
• WHERE LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE LESSER OF (A) THE TOTAL FEES YOU PAID TO US IN THE ONE (1) MONTH IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100
• IN NO EVENT WILL WE BE OBLIGATED TO PROVIDE ANY REFUND, CREDIT, OR MONETARY COMPENSATION BEYOND THIS LIMIT

You acknowledge that the fees for the Service reflect this allocation of risk, that these limitations are an essential basis of the agreement between us, and that we would not provide the Service without them. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Officely, LLC (the operator of Viewbot) and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of messaging platform terms of service
• Content you transmit through the Service
• Your use of unofficial or third-party messaging providers

11. Prohibited Uses

You may not use the Service to:

• Send spam, unsolicited messages, or violate anti-spam laws
• Transmit malicious code, viruses, or harmful content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, threaten, or harm others
• Engage in fraudulent activities
• Attempt to gain unauthorized access to our systems

12. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activities
• Non-payment
• Any reason at our sole discretion

Upon termination, you will lose access to the Service and all associated data. No refunds will be provided.

13. Modifications to Service and Terms

We reserve the right to:

• Modify or discontinue any part of the Service at any time
• Update these Terms at any time
• Change features, functionality, or pricing

Continued use of the Service after changes constitutes acceptance of modifications.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy or reliability of results

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Officely, LLC is registered, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and Viewbot regarding the Service and supersede all prior agreements.
